Terms of Use
This Terms of Use Agreement governs the relationship between the user (hereinafter the User), on the one hand, and Easyfind OÜ (hereinafter Easyfind OÜ), on the other hand (the User and Easyfind OÜ hereinafter jointly referred to as the Parties), in the easyfind online environment (hereinafter easyfind).
By registering and starting to use the easyfind online environment, the User confirms that:
- they have read and agree to the terms of this Agreement and undertake to comply with them;
- they have reviewed the easyfind online environment's privacy policy, agree to it and undertake to comply with it.
1. Definitions
1.1. easyfind — a virtual environment located on the www.easyfind.ee website, its subpages, and pages on social networks that belong to the company Easyfind OÜ, registry code 16841931.
1.2. User — a natural or legal person registered in the easyfind online environment.
1.2.1. Registered User – a natural person who has registered in the easyfind online environment;
1.2.2. Business Customer – a legal entity registered in the easyfind online environment;
1.2.3. General User – a natural or legal person who uses the online environment but has not registered.
1.3. Account — a virtual account of a natural or legal person in the easyfind online environment.
1.4. Service — a service provided to the User by Easyfind OÜ (including the service enabling the User to use the easyfind online environment, which consists of creating an account (easyfind account) for the User for the electronic management of their listings/advertisements).
1.5. Price List — a document specifying the prices (fees) for Easyfind OÜ services, available https://dev.easyfind.ee/hinnad/ and constituting an integral appendix to the User Agreement.
1.6. Business Day — a calendar day (from Monday to Friday, 9:00—17:00) that is not a public or national holiday.
1.7. Agreement — a document that governs the relationship between Easyfind OÜ and the User and establishes the legal basis.
1.8. Kasutustingimused – Easyfind OÜpoolt kehtestatud üldtingimused easyfind internetikeskkonna ja Teenuste kasutamiseks, mis on kättesaadavad easyfind veebileheküljel https://dev.easyfind.ee/kasutustingimused/
1.9. Legislation — legislation in force in Estonia.
1.10. Personal Data – any information relating to an identified or identifiable natural person (data subject).
1.11. User Level – the rights granted and obligations imposed on the User for using the easyfind online environment and Services (Standard User, Registered User or Business Client);
1.12. Work – written text (notices, advertisements, opinions, reviews, expert assessments, etc.), photographic works and works produced by methods analogous to photography, slides and slide films, short videos, audiovisual works, illustrations, etc.
2. easyfind basic terms of use of the online environment
2.1. easyfind online environment is intended to provide Services to the User.
2.2. The easyfind online environment may be used only in accordance with the Terms of Use. If the User does not agree to the Terms of Use, they have no right to register in the easyfind online environment.
2.4. Lisaks Kasutustingimustele võib Easyfind OÜ may establish Additional Terms for a Service offered in the easyfind online environment. If the User does not agree to the Additional Terms for the relevant Service, they are not entitled to use that Service. The Additional Terms form part of the Terms of Use.
2.5. The easyfind website may be used only with general-purpose web browsers, such as (but not limited to): Firefox, Internet Explorer, Opera, Chrome, etc. The easyfind online environment may not be used by programs that send automated requests to the easyfind online environment for any purpose.
2.6. easyfind online environment kasutamiseks tuleb isikul sõlmida Easyfind OÜ- Agreement. The Terms of Use are the terms of the Agreement. The User and Easyfind OÜmay agree on contractual terms that differ from or supplement the Terms of Use.
2.7. Before entering into the Agreement, the User is obliged to thoroughly review the Terms of Use.
2.8. Depending on the User Level, the Agreement with Easyfind OÜ is concluded as follows:
2.8.1. when the User actually starts using the Services (General User);
2.8.2. if the User has submitted an application for registration through the easyfind online environment and gains access to a personal easyfind user account (Registered User);
2.8.3. The Company has submitted an application for registration through the easyfind online environment and gains access to the easyfind business account (Business Customer)
2.9. Kui Kasutaja soovib easyfind kasutada muul viisil või eesmärgil, kui on ette nähtud Kasutustingimustes, on selleks vajalik Easyfind OÜ eelnev kirjalik nõusolek. Ilma Easyfind OÜeelneva kirjaliku nõusolekuta easyfind internetikeskkonna kasutamine muul viisil või eesmärgil, kui on ette nähtud Kasutustingimustes, on keelatud.
2.10. The User is obliged to pay for the use of the easyfind online environment Services in accordance with the Price List, unless otherwise stipulated in the Agreement.
2.11. conditions required to conclude an agreement with Easyfind OÜ:
2.11.1. To conclude a Contract with Easyfind OÜ, a User who is a natural person must be an adult (at least 18 years old).
2.11.2. A Contract may be concluded on behalf of a legal entity by its legal representative.
2.11.3. To conclude the Agreement, access to Smart-ID, Mobiil-ID, or a ID card, a Google account or an email address is required.
3. User levels
3.1. The following User Levels are defined in the easyfind online environment:
3.1.1. Standard User – may use the Services of the easyfind online environment to a limited extent without having to create a personal easyfind user account. The rights and obligations of a Registered User do not apply to a Standard User;
3.1.2. Registered User – may use the Services of the easyfind online environment, offer their goods and services to other Users, and rate Users with whom they have conducted transactions. In addition, the rights and obligations set out in the Terms of Use of the easyfind online environment apply to the Registered User.
3.1.3. Business Customer – may use easyfind Services and offer their goods and services to other Users, rate Users with whom they have conducted transactions, and only a Business Customer may publish information about engaging in the sale of used items.
3.2. An Ordinary User has the right to:
3.2.1. view the Content of the easyfind online environment;
3.2.2. perform searches in databases (a General User can see only the names of other Users, but not their contact details or the information they have published), and use other Services available to General Users;
3.2.3. create a personal easyfind user account (Registered User) or a Business Client account. In both cases, an agreement must be concluded with Easyfind OÜ by agreeing to the easyfind online environment Terms of Use and Privacy Policy.
3.3. A Registered User has the right to:
3.3.1. log in to the easyfind website;
3.3.2. save on the personal easyfind user account information about Users of interest;
3.3.3. receive new listings by email from saved Users of interest;
3.3.4. view the registered User and contact them via the easyfind website. Send purchase requests to sellers of a product, service or other offering of interest and request additional information;
3.3.5. provide an assessment of the Business Customer /Registered User and leave feedback in the comments about the goods or services received.
3.3.6. use all other Services available to the Registered User.
3.3.7. add their own listings, advertisements, discounts and other promotions.
3.4. The Business Client has the right to:
3.4.1. log in to the easyfind online environment;
3.4.2. use the Services available through the Business Customer account and other Services in accordance with the agreement concluded with Easyfind OÜ;
3.4.3. authorize natural persons acting on behalf of a company to use their user account.
3.4.4. advertise used items via the easyfind online environment.
4. Registration, duration and termination of the User Agreement
4.1. Registreerimisel peab Kasutaja esitama Easyfind OÜpoolt nõutavad tärniga tähistatud kohustuslikud andmed, aktsepteerima Kasutus- ning Privaatsustingimusi ja hinnakirja, milleks klõpsab Kasutaja selleks ettenähtud väljale, mida Easyfind OÜon loonud registreerumiseks kasutajaliideses.
4.2. Upon registration, in addition to other rights, the User will also gain access to a personal easyfind kasutajakonto, ettevõte puhul ärikliendikonto.
4.3. If the User has both a user account and a business account, the User may choose whether to use the user account or the Business Client account.
4.3. If the User does not pay on time for the use of easyfind online environment services, their account will automatically become inactive, other Users will not see the information associated with the account, and the User will not be able to publish information.
4.3.1. If the User wishes to reactivate their account, provided that it or parts thereof have not been deleted in accordance with the Personal Data retention periods arising from the Privacy Policy, the amount prescribed according to the applicable price list for the use of easyfind services and/or any outstanding debt must be paid, after which the account will become active no later than one business day after the financial obligation has been fulfilled and notification thereof has been sent to Easyfind OÜ.
4.4. The User's registration easyfind is valid indefinitely. The User's account is active if the User has paid for it according to the price list. The User can choose whether the active period lasts one month or one year.
If the User has not used their user account or business account for 365 days, Easyfind OÜwill warn the User that the user account or business customer account will be deleted. If the User does not respond, Easyfind OÜ will delete the user account or business customer account.
4.5. The Client has the right to terminate the user agreement and close the user account at any time.
4.6. If the User commits a material breach of the Agreement, Easyfind OÜ has the right to terminate the user agreement extraordinarily.
5. Identification and user account
5.1. The Registered User and Business Client are obliged to keep the information required to access the easyfind environment secret and secure so that it does not fall into the hands of third parties, except where the Registered User has authorised a third party to use their data to access the Services.
5.2. The User must immediately notify Easyfind OÜ if their username or password is lost or comes into the possession of persons whom they have not authorised to use the data. The notification must be digitally signed.
5.3. The User is responsible for transactions made using their account or for information published on their behalf.
5.4. To use certain Services, Easyfind OÜmay require the User's identity to be verified using an ID card, Mobile-ID, or Smart-ID.
6. User rights, obligations and restrictions
6.1. easyfind In the online environment, the User has the right to register and use only one Registered user account, but the User may be associated with one or more business accounts.
6.2. The User has the right to purchase services or products published in the easyfind online environment and to publish a listing or advertisement in their own name solely in relation to a service offered or product sold by the User.
6.3. The User undertakes to conduct themselves in the easyfind online environment in accordance with the user agreement and the legislation of the Republic of Estonia.
6.4. The User undertakes to be responsible for the content of listings published in the easyfind online environment, the quality and availability of services and products, as well as the accuracy of their descriptions.
6.5. The User is responsible for the proper performance of the obligations undertaken by them in the easyfind online environment.
6.6. The User is required to provide only accurate data in the easyfind online environment.
6.7. The User is obliged to immediately notify Easyfind OÜ of any problems encountered while using the easyfind online environment, clearly explaining the nature of the problem.
6.8. The User is obliged to inform Easyfind OÜ of circumstances that may prevent the proper fulfilment of these terms and conditions.
6.9. The User grants the audiovisual content of their listings, including texts, to Easyfind OÜ on a non-exclusive basis and undertakes to refrain from activities that could place an excessive load on the infrastructure of the easyfind online environment.
6.10. The User undertakes to refrain from using any automated programs to collect or gain access to information contained in the easyfind online environment.
6.11. The User is obliged to ensure that the files they upload to the website and easyfind emails sent to the online environment or another User do not contain computer viruses or other computer programs or files that damage or otherwise interfere with, or may damage or interfere with, the normal operation of the website, nor programs or files that may be saved on the computers of other Users of the website, damage them, or interfere with the normal functioning of those computers.
6.12. It is prohibited to use another person's copyrighted Work or a derivative Work thereof without the consent of the owner of that Work and the copyright therein (author, performer, licensee, employer, database maker, etc.). The User ensures that adding the Work to easyfind complies with applicable legislation.
6.13. If the User publishes opinions in the easyfind online environment about another User or a product or service offered by them, such opinions must be honest and objective, and in the event of a dispute, the person who expressed the opinion must be able to substantiate and prove it.
6.13.1. An opinion must not defame, humiliate, ridicule or insult another person's honour and good name, nor may its purpose be to maliciously or groundlessly disparage a service or product.
6.13.2. The User acknowledges that providing false information may cause harm to another User or the manufacturer of a product, and that they have the right to claim, among other things, compensation for the damage caused.
6.13.3. The User is aware that OÜ Easyfind will disclose the details of the User who provided the opinion to a person who believes that their rights have been infringed by an incorrect opinion.
6.13.4. The User is aware that OÜ Easyfind does not review published opinions.
6.13.5. Incitement to hostility and hatred, persecution, as well as discrimination based on gender, race, ethnicity or religion, beliefs, property or social status is also prohibited.
6.13.6. A product or service may only be rated by a User who has purchased that product or used that service. The rating may not be based on statements made by third parties.
6.13.7. OÜ Easyfind has the right to delete opinions and/or suspend their publication.
6.14. It is prohibited to burden the easyfind environment with information unrelated to the purpose of this environment.
6.15. The User is obliged to keep confidential the personal data and confidential information that becomes known to them while using the easyfind online environment, including, but not limited to, the identities of other Users, except where the right or obligation to disclose arises from law or where the relevant person has consented to the disclosure.
6.16. Easyfind OÜ has the right, BUT NOT THE OBLIGATION, to check information added by the User and the Users' activities in the easyfind online environment, and to remove non-compliant information or restrict the publication of non-compliant information or non-compliant activities.
6.17. Easyfind OÜis not required to monitor the activities of Users or any information added by them that Users transmit, cache or store through the easyfind online environment, nor to search for facts or circumstances indicating illegal activity. However, Easyfind OÜ is required to provide information upon request to competent authorities, such as Politsei- ja Piirivalveamet, Andmekaitse Inspektsioon, Maksu- ja Tolliamet, etc.
6.18. Disputes between the User and Easyfind OÜshall be resolved through negotiations. If no solution is reached through negotiations, the dispute shall be resolved in accordance with the legislation of the Republic of Estonia, and, in the case of a User who is a legal entity, in Harju County Court.
6.19. Easyfind OÜand the User may not publish links to third-party websites in the easyfind online environment.
6.20. Different terms and policies may apply to third-party services and websites than those in the Terms of Use and Privacy Terms, and Easyfind OÜcannot control their application. Easyfind OÜis not responsible for the content or activities of third-party services and websites, or for the practices, rules and policies applicable there. The User is obliged to familiarize themselves with the practices, rules and policies applicable on third-party websites.
6.21. The User has the right to send complaints related to the functioning of the website or violations by other Users to Easyfind OÜ. They must be submitted by email to: easyfind@easyfind.ee
7. Publishing a listing/advertisement and using other services
7.1. When submitting a listing, photo, video, advertisement or text, the User is required to provide only true and accurate information. The User is prohibited from publishing misleading or inaccurate information. Texts, photos, videos and information published by the User via the easyfind online environment must comply with legislation, good practices and customs. By agreeing to these Terms of Use, the User confirms that the information they publish via the website:
7.1.1. are not misleading, inaccurate, or incorrect;
7.1.2. do not contain offers to provide services or sell goods whose provision or sale is not compliant with legislation;
7.1.3. do not infringe the proprietary or non-proprietary rights of third parties, including intellectual property rights belonging to third parties;
7.1.4. are not contrary to legislation or good morals and practices.
7.2. The User is responsible for the data published by the User (and its accuracy).
7.2.1. Easyfind OÜis not responsible for the accuracy of information published by the User, the quality of a product or service offered by the User, or the performance of an agreement entered into between Users.
7.2.2. All listings and comments added by the User to the easyfind online environment are subject to prior moderation. Listings and comments will become visible on the website no later than one business day after submission, provided that they comply with the Terms of Use and do not violate the legislation of the Republic of Estonia.
7.3. The User undertakes to immediately inform Easyfind OÜ by email if any of the data published by the User through the easyfind inetrnet website has become inaccurate, incorrect or unlawful after publication.
7.4. Easyfind OÜ has the right to choose its contractual partners at its own discretion.
8. Basic terms of advertisements
8.1. The advertisement must be clear, and the information published in it must be truthful; among other things, the advertisement must not create an unjustified impression, for example, that the information presented has a scientific basis (RekS § 3 subsection 4 clause 11 and clause 14).
8.2. The User acknowledges that it is their responsibility to prove the truthfulness of any advertising claims.
8.3. When publishing information, the User must comply with, among other things, the Advertising Act.
8.3.1. Section 3 of the Advertising Act sets out the basic requirements for advertising, and subsection 4 of the same section sets out the restrictions that the User must comply with when publishing information on the easyfind portal.
8.4. Processing an advertisement, photo or other file for the purpose of attracting attention is prohibited.
8.5. Photos or other files added to the advertisement's photo fields may depict either specific or various products/services. The User chooses the design of their advertisement and the manner in which information is communicated to others, but it must comply with the easyfind online environment terms and conditions.
8.6. The User specifies in their account which words are used as search terms (words that make it easier to find a specific product or service). Search terms must consist of either one or a maximum of two words and must be clear and specific (for example, “hairdresser”, “house cleaning”, “washing machine repair”, etc.). The number of terms is not limited, but the terms must be related to the User who published the advertisement and/or their activities.
8.7. Rules for the “Work/workspace rental” category.
8.7.1.Principles
- The job title and the description of job duties stated in the job advertisement must correspond so that the job duties and/or position are clear;
- Job duties and conditions, including requirements for the applicant (such as foreign language proficiency, possession of a driving licence, etc.), must be described as clearly as possible;
- A job advertisement may only be posted by the legal representative of the company offering the job.
8.7.2. If so-called workstation rental is offered (hairdressers, beauty services), it must be clearly distinguishable from a job advertisement.
8.7.3. The advertisement title must contain only the job title (in the nominative case).
8.8. It is prohibited to publish information:
- about a product or service whose sale or provision is illegal;
- about intimate services;
- whose published content is contrary to the Advertising Act or another legal provision of the Republic of Estonia;
- that conflicts with the Terms of Use;
8.9. It is prohibited to publish advertisements concerning the following persons or services:
8.10. Only information appropriate to the designated fields (corresponding to the field name) may be added.
8.11. Texts must comply with spelling rules. The use or repetition of inappropriate characters is prohibited.
8.12. Advertisements must correspond to the category under which they are intended to be published. For example, adding car repair services or other advertisements to the organic products category is prohibited.
8.13. The User may include links to their website and online store.
8.14. The User may advertise their business or activities using pictures, texts, pdf files, short viideos, slides and slide shows.
8.15. Only a Business Customer may sell or advertise used products.
8.16. The User is not permitted to sell prohibited goods, services or products that violate Easyfind OÜ intellectual property rules, even if they comply with Easyfind OÜ other marketplace conditions.
8.17. Resale is prohibited in the handmade (goods) category. Resale means offering for sale a handmade item that was neither designed nor made by the User.
Please note that members and, in some cases, third parties may report advertisements that they believe violate Easyfind OÜ rules or the interests or rights of a third party, such as a manufacturer, product reseller, owner of an item, etc., and ask Easyfind OÜ to review them, including suspending them or requiring disclosure of the identity of the person who published the information. Easyfind OÜ may remove any advertisements or other information or content that violates the Easyfind OÜ Terms of Use. If Easyfind OÜ has suspended the User's account due to any violations, payments made for services will not be refunded.
8.18. Duplicating advertisements, i.e. repeatedly posting advertisements with identical or very similar content, is prohibited, including for the purpose of gaining greater visibility on the homepage or in search results. Easyfind OÜ has the right to remove duplicate advertisements without prior notice.
9. Conclusion of sales transactions and liability
9.1. Easyfind OÜdoes not itself participate (for example, as an agent, broker, commission agent, representative or otherwise) in actual sales and other transactions concluded between Users as a result of offers published in the easyfind online environment.
9.2. Users conclude sales transactions in the easyfind online environment without the intervention of Easyfind OÜand are fully responsible for the performance of the contracts concluded between them and the terms of sale.
9.3. The User understands and is aware that if the other party to the transaction who sells something or offers a service is not a trader, the consumer rights arising from European Union consumer protection legislation do not apply to a contract concluded between Users as a result of an offer published in the easyfind online environment.
9.4. If Easyfind OÜbecomes aware of an infringement committed or ongoing through the website, it shall remove the relevant content or block access to it. Easyfind OÜis not liable for infringements committed or ongoing through or by means of the easyfind online environment or for their consequences, including where such consequences result from a breach of obligations under a contract between two Users.
9.5. Easyfind OÜei vastuta kahju eest, mis tekkis Kasutajale või kolmandatele isikutele seoses sellega, et Easyfind OÜkasutas oma õiguskaitsevahendeid (näiteks eemaldas veebilehelt sisu, tõkestas sellele juurdepääsu, piiras Kasutaja õigusi või tõkestas tema juurdepääsu oma kasutajakontole või veebilehele), kui see oli vajalik Easyfind OÜ-lerikkumise kohta esitatud kaebuse või Easyfind OÜ-ltekkinud rikkumise kahtluse tõttu või otseselt seetõttu, et sisu või Kasutaja käitumine on vastuolus Kasutustingimuste, hea tava või õigusaktidega. Sellisel juhul ei vastuta Easyfind OÜtekkinud kahju eest isegi juhul, kui kaebus oli põhjendamatu või kui hiljem selgub, et tegemist ei olnud rikkumisega.
9.6. If the User has used another person's copyrighted work or a work derived from it in the easyfind online environment, or has otherwise infringed someone's copyright, Easyfind OÜis not liable for damage caused to the User or third parties through the use of such a work. The User shall resolve all such disputes and bear the related costs.
9.7. Easyfind OÜis not responsible for the quality, quantity, location, accessories, origin, or legality of goods sold, nor for the quality of a service offered by the User. Responsibility lies with the User who sells the goods, provides the service, or published the relevant listing.
9.8. OÜ Easyfind OÜ ei ole Kasutajate vaheliste vaidluste lahendajaks ega lahenda Kasutaja pretensioone teise Kasutaja vastu, mis puudutab toodet, teenust, autori- või muude õiguste rikkumist.
10. Rights and obligations of Easyfind OÜ
10.1. Easyfind OÜ has the right to unilaterally amend the Terms of Use and price lists in line with the development of the Services and the easyfind website.
10.2. Easyfind OÜmay amend the Terms of Use if necessitated by a change in applicable legislation or its interpretation, the introduction of a new Service or the discontinuation of an existing Service, in response to ongoing complaints from Users, upon the entry into force of a court judgment or administrative act requiring Easyfind OÜto amend the Terms of Use, where necessary to enhance the protection of User data, in the event of changes to the operation of the easyfind online environment, or upon technological developments that enable improvements to the administration of the easyfind website or to the quality and security of the Services.
10.3. Easyfind OÜshall notify Users of amendments to the Terms of Use or price lists via the Website in good time before the new Terms of Use or price lists take effect. If the User continues to use the easyfind website and the Service after the expiry of the specified period, the User shall be deemed to have accepted the amendments to the Terms of Use and/or price lists. Amendments that have entered into force do not apply to Services that were paid for or contracted before the amendments entered into force.
10.4. Easyfind OÜ has the right to restrict the User's rights when using the easyfind website or terminate the User's registered status if the User breaches these Terms of Use. In certain cases, additional time may be granted to remedy the breach, depending on its extent, nature and possible consequences, including whether there have been previous breaches.
10.5. Easyfind OÜ has the right, but not the obligation, to review the listings, texts, and photos submitted by the User on the easyfind website and to remove listings that contain inaccurate or misleading information, the publication of which would constitute an infringement, or by publishing which the User has otherwise violated the Terms of Use.
10.6. Easyfind OÜ has the right to restrict access to the easyfind website for persons who fail to comply with these Terms of Use or who violate legislation when using the easyfind website. If the User's rights are restricted, the User will be notified thereof, and any disputes will be resolved through negotiations or in court.
10.7. Easyfind OÜ reserves the right not to refund the User any fee paid for any service if the User decides to discontinue the service before the end of its term or if the contract is terminated due to a breach by the User.
11. Copyright
11.1. Easyfind OÜ-le kuuluvad kõik autoriõigused ja nendega kaasnevad õigused (andmebaasi tegija õigused) andmebaasidele ja nendes sisalduvatele teostele, sealhulgas tarkvarale, Easyfind OÜ poolt avaldatud uudistele, sõnumitele, tekstidele, easyfind’ graafilisele, muusikalisele jm kujundusele.
11.2. The Works in respect of which the author's economic rights are assigned and an exclusive licence is granted in respect of personal rights under this chapter include written text published or to be published by the User in the easyfind environment, including advertisements, forum messages, opinions, reviews, expert assessments and the like; photographic works and works produced by processes analogous to photography; slides and slide films; audiovisual works; illustrations; and the like.
11.3. The User assigns to Easyfind OÜ, free of charge, all economic rights listed in clause 11.2 within the meaning of the Copyright Act in respect of the Work, including the rights to reproduce, distribute, translate, adapt, compile and create databases from the Work, publicly perform it, make it available to the public, etc., in any form and by any means, without geographical restrictions and for the entire term of copyright protection, without restrictions with respect to third parties. The economic rights are deemed to have been assigned to Easyfind OÜ immediately upon uploading the Work to the Easyfind OÜ environment.
11.4. For the Works listed in clause 11.2, the User grants Easyfind OÜ a free exclusive licence (permission) to exercise the User's moral rights in the easyfind online environment in any form and manner within the meaning of the Copyright Act, without geographical restrictions and for the entire term of copyright protection, without restrictions vis-à-vis third parties. The User limits the manner and scope of exercising their moral rights as set out in the Terms of Use. Easyfind OÜ has the right to grant sublicences in respect of the User's moral rights. The exclusive licence is deemed granted by the User to Easyfind OÜ immediately upon uploading the Work to the easyfind environment. The exclusive licence granted under the Terms of Use covers all subsequent developments of the Work. The User agrees, if necessary, to make any changes to their Work and the designation of the User's name, and to add other works, illustrations, comments, etc. to their Work. The User agrees that Easyfind OÜis not obliged to credit the User as the author of the Work.
11.5. Easyfind OÜ-l on õigus luua Kasutaja Teose alusel tuletatud teoseid Teose edasiarendamise teel. Autoriõigus tuletatud teostele kuulub Easyfind OÜ-le. Kasutaja on nõus, et Easyfind OÜei ole kohustatud kajastama tuletatud teose juures Kasutaja kui algse Teose autorinime, Teose pealkirja (nimetust) ega allikat, kus Teos on avaldatud. Tuletatud Teosed on näiteks Kasutaja poolt easyfind keskkonda üles laetud fotod täienduste, muudatuste või muude lisamistega (sealhulgas fotode mõõtude muutmine, failinime muutmine, foto kvaliteedi tõstmine, vesimärgi lisamine, jms). Easyfind OÜ-l on õigus Kasutaja poolt easyfind internetikeskkonda üleslaetud Teosed (näiteks fotograafiateosed) kustutada ja kasutada easyfind keskkonnas vaid Easyfind OÜpoolt loodud tuletatud teoseid.
11.6. Kasutajal ja teistel isikutel ei ole ilma Easyfind OÜeelneva kirjaliku nõusolekuta õigust easyfind keskkonda ja selle koostisosi mistahes viisil reprodutseerida (kopeerida), levitada, edastada, tõlkida, lülitada teistesse andmebaasidesse, teha väljavõtteid jms viisil kasutada.
11.7. The use of easyfind or the Works forming part of it by the User or another person without the consent of Easyfind OÜis unlawful and entails liability prescribed by law.
11.8. By starting to use the easyfind online environment, the User confirms that they are aware of Easyfind OÜcopyright and related rights (the rights of the maker of a database) and undertake not to infringe Easyfind OÜrights or permit other persons associated with them to exercise Easyfind OÜcorresponding rights in this manner.
11.9. By adding Works or Content to the easyfind environment, the User confirms that they own the copyright or other intellectual property rights to that Work or Content, or have another legal basis for adding the Work or Content.
11.10. Easyfind OÜand the User are liable for violations of the copyright requirements set out in this section of the Terms of Use, taking into account the exceptions specified in the “Easyfind OÜliability” section of the Terms of Use (see clause 14 of the Terms of Use).
12. Quality and availability of services
12.1. Where necessary, Easyfind OÜmay update the mechanisms underlying the operation of the easyfind environment in order to provide Users with the best service, without requesting the User's permission.
12.2. By accepting the Terms of Use, the User agrees and confirms that:
12.2.1. easyfind The form and nature of the Services may change from time to time without prior notice;
12.2.2. Easyfind OÜmay, at its discretion, discontinue (permanently or temporarily) the provision of the Services or any part thereof to the User in order to carry out maintenance work, by giving at least two working days' notice ;
12.3. Easyfind OÜis not liable for the temporary interruption of the provision of the service(s) offered by it or any part thereof if this occurs during maintenance work announced to the User in advance or due to any other circumstance for which OÜ Easyfind cannot be held liable.
12.4. Easyfind OÜis not liable for the failure of the Service to function or for other breaches caused by force majeure. Force majeure means any unforeseeable event that does not depend on Easyfind OÜ or the User or is beyond their control, such as fire, explosion, natural disasters, war, decisions by public authorities, as well as interruption of the internet connection, technical failures in payment services (bank link, credit card payment, etc.), and so on.
13. Easyfind OÜ legal remedies
13.1. If the User violates the Terms of Use or legislation, Easyfind OÜ has the right to:
13.1.1. temporarily restrict the User's rights to use the easyfind online environment;
13.1.2. temporarily block the User's personal easyfind user account or business customer account;
13.1.2.1 for three days for the first violation;
13.1.2.2. for seven days in the event of a second violation;
or if the User repeatedly or materially violates the Terms of Use or has received 3 violation notices from Easyfind OÜ, Easyfind OÜ has the right to:
13.1.3. prohibit the User from using the relevant Service;
13.1.4. delete the User's personal easyfind user account or business customer account without the option of creating a new account in the future;
Please note that no violation notice will be issued for the first violation of the rules.
13.2. If Easyfind OÜ receives a relevant complaint or it becomes apparent that the Content submitted by the User to Easyfind OÜ or added to easyfind’ is contrary to the Terms of Use or legislation, then Easyfind OÜ has the right to:
13.2.1. modify or delete non-compliant Content or any part thereof if it is evident that it does not comply with the Terms of Use or legislation;
13.2.2. Temporarily remove the Content from the easyfind online environment or block access to it without deleting it.
13.3. In addition to the provisions of clauses 13.1 and 13.2, Easyfind OÜ has the right to demand from the User a contractual penalty of 50.- euros for each infringement and compensation for damage not covered by the contractual penalty, particularly if the User has violated the subclauses of the Terms of Use in chapters 6, 7 or 11 and the clauses defined in the rule “Advertising Prohibitions and Restrictions”.
13.4. Easyfind OÜ has the right to block access to the easyfind keskkonnale isikul, kes kasutab easyfind environment without Easyfind OÜpriorconsent in a manner or for a purpose other than those provided for in the Terms of Use.
13.5. If Easyfind OÜapplies legal remedies, the User may consequently lose access to the Services, their account data, or any files or other information contained in the user account.
13.6. In the event of a breach of a monetary obligation, Easyfind OÜ has the right to suspend the performance of its obligations and demand payment of täitmine ja nõuda viivise määraga 0,06% per day.
14. Liability of Easyfind OÜ
14.1. When Users use the Services and add Content to the easyfind server space in the form of listings, advertisements, comments and images, easyfind becomes aware of the relevant Content or Users' activities in the following ways:
14.1.1. by means of a complaint submitted to Easyfind OÜ;
14.1.2. as a result of random checks by Easyfind OÜadministrators;
14.1.3. upon receipt of a non-automated request from the User to add Content to Easyfind OÜ.
14.2. Easyfind OÜdoes not verify the accuracy of Content added by Users and is not responsible for it.
14.3. If Easyfind OÜbecomes aware of an infringement (of the law) committed or ongoing through easyfind, it shall remove the non-compliant Content or block access to it. Easyfind OÜis not responsible for any infringement committed or ongoing through easyfind or its consequences.
14.4. If the User has used in a Work another person's copyright-protected work or a derivative work thereof, Easyfind OÜshall not be liable for any damage caused to the User or third parties by the use of such work.
14.5. Easyfind OÜis not responsible for the quality, quantity, location, accessories, origin or legality of goods sold or offered in the easyfind environment.
15. Display of listings
15.1. When displaying listings on the easyfind website, the listing order filter selected by the User is applied. If the User does not select a filter but searches for a product or service using the search bar, the more relevant listings are displayed first by default, taking into account the other search filters selected by the User. Where relevant, listings are displayed according to the User's rating in the previous search result. The User's rating is displayed next to the listing. Listings with a higher rating are displayed first. In the event of equal ratings, the general search order filter selected by the User, such as location, language of communication, etc., is applied. The rating is based on evaluations provided by Users.
15.2. For goods and services, the User may purchase the additional service “listing on the front page”, in which case the listing will be displayed on the front page.
16. OTHER TERMS
16.1. All disputes and disagreements will be attempted to be resolved through negotiations.
16.2. All disputes shall be resolved in accordance with the laws of the Republic of Estonia and shall be subject to the jurisdiction of Estonian courts.
16.3. The User is aware that, upon receiving a corresponding request, Easyfind OÜ provides information about the User and transactions related to them to Politsei- ja Piirivalveamet, the courts, Maksu- ja Tollimaet, persons who have a statutory right to receive such information and to whom Easyfind OÜ is legally obliged to provide such information.
16.4. All notices, complaints, claims, etc. related to the agreement and its performance shall be sent by email. Each party must ensure that the information it provided during registration is correct and immediately notify the other party of any changes.
16.4.1.A notice is deemed to have been delivered to the Business Customer on the working day following the sending of the notice.
16.4.1.1. The User's email address is the email address provided when registering the account.
16.4.1.2. Easyfind OÜThe email address is: info@easyfind.ee
16.4.2.A notice shall be deemed received on the business day following its dispatch if the recipient is a legal person, and within 5 business days if the User is a natural person.
17. The Price List, Privacy Policy and “Advertising Prohibitions and Restrictions” form integral annexes to the Terms of Use.
